Rationale for use in Home Entertainment Suppliers[edit]

  • This image shows the seal introduced by HES to combat claims by Nintendo that games sold without the Nintendo Seal of Quality could not be guaranteed to operate properly on NES hardware. Showing the image allows readers to compare it with the NES symbol, and understand the article's comparison between the two.
  • The image is being used in an appropriate educational and transformative way, as envisaged by US Fair Use law, to further a discussion of the history of HES and the presentation of its products, in a way that in no sense conflicts with the original use of the symbol. It is in any case questionable whether the sybmol sufficiently achieves the required threshold of originality to attract US copyright protection.
